Prenaptial mediation is another way to create a marriage contract. In this process, a mediator allows for an open discussion between the couple on all kinds of marriage issues, such as work expectations after the birth of the children and saving and spending styles, as well as traditional pre-marriage discussions about asset sharing and the couple`s alimony at the end of the marriage. The engaged couple, with the help of the mediator, makes all decisions about what would happen in the event of separation or divorce. They then draft a memorandum of agreement or prenoptial agreement and have it reviewed by their respective lawyers. An agreement developed through mediation is usually more cost-effective because fewer hours are spent with lawyers because the couple has made all the decisions together rather than one party against the other. Couples enter into a written marriage contract to replace many of the marriage laws that would otherwise apply in the event of divorce, such as laws governing asset division, pension benefits and savings, and the right to apply for alimony (spousal support) with agreed terms that provide security and clarify their matrimonial rights.   A prenutial agreement may also include a waiver of a surviving spouse`s right to claim an elective share of the deceased spouse`s estate.  Prenutial arrangements (also known as prenutial contracts or “prenutial agreements”) are a common legal measure taken before marriage. A prenup determines the property and financial rights of each spouse in the event of divorce. So, while no one thinks about divorce when they get married, about half of all marriages in America end in divorce proceedings.
Therefore, it is often advisable to consider at least one marriage contract. Prenups are often used to protect the wealth of wealthy spouses, but they can also protect family businesses and perform other important functions. .
